Client Service Agreement

This Client Service Agreement (Agreement) sets out the terms under which Your Biz Wiz (we, us, our) provides services to you (you, the Client).

By proceeding with payment for any service offered by Your Biz Wiz, you confirm that you have read, understood, and agree to be bound by this Agreement.

Services
Your Biz Wiz provides business automation, websites, CRM systems, AI tools, and related digital services as selected by the Client at checkout or otherwise agreed in writing.
The specific services, pricing, billing cycle, setup fees, discounts, or trial terms applicable to you are those displayed and confirmed at the time of checkout (Selected Plan).
Services are provided strictly in accordance with the Selected Plan. Any work outside the scope of the Selected Plan may require additional fees or a separate agreement.
Subscription Services
Where services are provided on a subscription basis:
• Subscriptions are billed on a recurring basis as displayed at checkout.
• Billing continues until the subscription is cancelled in accordance with this Agreement.
• Changes to public pricing do not affect existing subscriptions unless otherwise agreed in writing.
Setup Fees
Some services may require a one-time setup fee.
• Setup fees are charged as displayed or agreed at checkout.
• Setup fees are non-refundable once work has commenced.
• Discounted or waived setup fees may be offered at our discretion and are confirmed at checkout.
Payment and Billing
• All fees are payable in Australian Dollars unless otherwise stated.
• Payment is due in advance for subscriptions and setup fees.
• By providing payment details, you authorise Your Biz Wiz to charge applicable fees in accordance with your Selected Plan.
• Failed, reversed, or overdue payments may result in suspension or termination of services.

Trials and Promotions
Where a trial period or promotional pricing applies:
• Trial terms are limited as described at checkout.
• Services may be restricted during trial periods.
• Unless cancelled before the trial ends, the subscription will automatically convert to the standard paid plan.
Client Responsibilities
You agree to:
• Provide accurate, complete, and up-to-date information during onboarding.
• Respond to requests for approvals, content, or access in a timely manner.
• Ensure you have authority to provide any materials, data, or access credentials supplied.
• Review and approve work where approval is required.
Your Biz Wiz is not responsible for delays caused by incomplete information, delayed approvals, or lack of access provided by the Client.
AI and Automation Disclaimer
Your Biz Wiz may provide AI-powered tools including chatbots, voice agents, and automations.
You acknowledge that:
• AI outputs are not guaranteed to be accurate, complete, or error-free.
• AI responses are provided for general information purposes only and do not constitute professional advice.
• You are responsible for reviewing, approving, and monitoring AI behaviour before and during live use.
• Your Biz Wiz is not responsible for business decisions, outcomes, or losses arising from reliance on AI outputs.
Call Recording and AI Voice Services
Where applicable, calls handled by AI voice agents or staff may be recorded or processed for the purposes of service delivery, quality assurance, training, and system improvement. By using our services, you consent to such recording or processing. You are responsible for ensuring that your customers are informed where required by law.
Third Party Services
Our services may rely on third-party platforms, software, or service providers.
• Your Biz Wiz is not responsible for outages, interruptions, errors, or changes caused by third-party services.
• Fees charged by third-party providers are not controlled by Your Biz Wiz and are the responsibility of the Client unless otherwise agreed.
Cancellation
You may cancel your subscription by providing at least 7 days’ notice before your next billing date, unless otherwise stated at checkout.
• Cancellation prevents future charges but does not refund amounts already paid.
• Access to services may be suspended or removed upon cancellation or non-payment.
Refunds and Australian Consumer Law
Except where required by Australian Consumer Law:
• Setup fees are non-refundable once work has commenced.
• Subscription fees are non-refundable for partially used billing periods.
• Refunds are not provided for change of mind or unused services.
Nothing in this Agreement excludes, restricts, or modifies any consumer guarantees, rights, or remedies conferred by Australian Consumer Law that cannot be excluded by law.
Limitation of Liability
To the maximum extent permitted by law:
• Your Biz Wiz is not liable for indirect, incidental, special, or consequential loss, including loss of profits, revenue, data, or business opportunities.
• Our total liability arising out of or in connection with this Agreement is limited to the amount paid by you to Your Biz Wiz in the three months preceding the event giving rise to the claim.
Suspension and Termination
Your Biz Wiz may suspend or terminate services immediately if:
• Payments are overdue or reversed.
• This Agreement is breached.
• Services are used unlawfully, abusively, or in a manner that exposes risk.
Termination does not waive any outstanding payment obligations.
Changes to This Agreement
We may update this Agreement from time to time.
• The version in effect at the time of your checkout applies to your services.
• Updated versions apply to new clients and future purchases only.
Governing Law
This Agreement is governed by the laws of Victoria, Australia, and the parties submit to the exclusive jurisdiction of the courts of Victoria.
Priority of Agreement
If there is any inconsistency between this Agreement and any other terms or policies published by Your Biz Wiz, this Agreement prevails.
